Postal services & the postal market: towards full market opening

According to the basic statistics on Postal Services in Europe (Eurostat DATA in focus of Dec. 2007 at the following site: http://ec.europa.eu/eurostat), postal services account for some 1% of EU GDP and 5 million people employed in the sector. We note the significance of postal services; they are indeed what we call a “Lisbon deliverable”, and the European Parliament Resolution of 2nd February 2006 on the application of the Postal Directive (OJ C 288E/77/25.11.06) highlights the social and economic importance of efficient postal services and their important role within the framework of the Lisbon Strategy.

Postal services stand at the crossroads between communications, advertizing – e-commerce and transport. They are a key industry which, together with transport and communication services, holds the internal market and its citizens together.

The Court of Justice of the European Union and the directive 97/67/EC concerning liberalization and universal service in the field of Postal Services

In 28.10.2010 the Court of Justice of the European Union (hereinafter: the CJ) has condemned Greece for violation of the directive 97/67/EC concerning liberalization and universal service in the field of Postal Services. The CJ ruled that Greece has been in breach with article 9 paras 1 and 2 of the above mentioned directive by maintaining and applying the provisions of the Ministerial Decision A1/44351/3608 (Official Gazette of the Hellenic Republic, FEK ´ 1491/12-10-2005). The European Commission plaid before the Court that the national provisions in question introduced two further restrictions not permitted by the system of the Directive: first, franchisees of postal companies operating under a general license, prior of being able to be qualified for obtaining a van license, needed to cease to be members of the network of the franchisor, in order to be eligible – as autonomous company – for a general or special license to provide postal services. Second, the transport vans permitted to be used for Private Use couldn’t be over 4 tons. For heavier vans operators had to seek cooperation with tenors of a Public Use van license.
